GENERAL TERMS OF TRAINING

Unless otherwise specified, our services are carried out under the following general conditions:

Article 1

The general conditions aim to define the terms of negotiation, conclusion, and execution of any contract related to the implementation of a professional continuous training action falling under the scope of Article L900-2 of the Labor Code or any other ancillary service.

Article 2

From a legal and regulatory standpoint, our company, named SAMR SAS, is registered for its professional continuous training activity under the number: 21 10 00802 10. In this context and within legal limits, the concerned companies can charge the training expenses incurred with SAMR SAS against their participation in professional continuous training.

Article 3

The training provided by SAMR SAS is carried out in accordance with the order from the company, institution, or individual requester. The content of the course and all specific conditions are detailed in advance in the proposal submitted to the company, institution, or individual requester.

Article 4

To ensure proper pedagogical functioning, the number of participants in a training session is limited. Registration requests are recorded in the order they are received. A waiting list for a few spots is established.

Article 5

SAMR SAS may be obliged to cancel or postpone any training session (notably in case of insufficient participants). Furthermore, SAMR SAS reserves the right to cancel or postpone a training session or change the location for pedagogical reasons or force majeure. (Note: repeated absences from a training session may lead the control service to refuse the charging of registration fees against the mandatory participation in professional training). In case of the participant’s absence from the training, resulting in non-payment by the organization managing the training funds, the company agrees to pay the invoice to SAMR SAS.

Article 6

Unless otherwise stipulated, our invoices are payable within 30 days from the invoice date. The contractual price agreed upon in the proposal is expressed excluding tax and is subject to VAT at the applicable rate.

Article 7

In case of disputes and after failure to reach an amicable solution, exclusive jurisdiction is granted to the courts of the SAMR SAS headquarters.

Article 8

Absenteeism:

  • Individual training: Any anticipated absence must be reported at least 15 days in advance in writing (fax, email) to determine a rescheduling date; otherwise, an invoice will be issued to the company.
  • Inter-company training (collective): Absence, whether planned or not, from a session cannot be rescheduled. Therefore, no price reduction will occur. SAMR SAS will issue an invoice to the company.

Cancellation, early termination, suspension: Any registration canceled or postponed at the company’s request must be done at least 15 working days before the start date of the training. After this date, a compensatory indemnity for incurred costs is due to SAMR SAS based on:

  • 50% of the pedagogical costs if the request for postponement is made between the 15th and the 8th day before the start date of the training.
  • The total amount if the request is made within 7 days before the start date of the training.

Article 9

The express or implicit acceptance of the proposal by the company, institution, or individual requester automatically implies acceptance of these general conditions. Moreover, no clause from the general conditions of the company or institution can be opposed to SAMR SAS unless it has been expressly accepted.

Article 10

The training dates indicated in the proposals have a validity period of 2 weeks. Without acceptance from the client within this period, the options will be lifted.
